Right of Way Use Permits

A Right of Way Use permit is required for work in the right of way (ROW) such as excavating, altering, placing structures, blocking roadways or sidewalks, materials delivery for construction sites, or other activities in the ROW. MICC 19.09.060 regulates ROW use. Work hours are generally 9 am to 3:30 pm in the street on school days. Work hours on school bus routes may be further restricted.

How to Apply

Email all plans, forms, and documents to epermit.tech@mercerisland.gov, in PDF format.

Prepare

Select a contractor and confirm that they have a Mercer Island Business License. Prepare a traffic control plan if the work will impact traffic, bicyclists, or pedestrians through work in or adjacent to roadways, shoulders, paths or sidewalks. Here are some sample traffic control plans. Traffic control plans for work on arterial streets must be prepared by a certified Traffic Control Supervisor unless waived by the City Engineer.
